Parental Rights

In Illinois, both parents are presumed fit to parent their child.

The Illinois Parentage Act of 2015 ensures that every child has the right to:

  • Physical
  • Mental
  • Emotional
  • Financial Support (from both their parents).

Parental rights also include the right to parenting time with the minor child. Both parents are entitled to have access to their child’s school records, medical records and the right to be informed and make inquiries about their child. Often times, parents have a child in common but have no court order establishing parental rights, responsibilities, and allocated expenses for the minor child.  In Illinois, with no court order, no one parent has a greater right to their child.
